Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets forth the rules that govern the use of any Carmen Hosting Company ("Carmen," "we," "us," or "our") services, including virtual private servers (VPS), dedicated servers, and cabinet colocation (collectively, the "Services"). By accessing or using our Services, you ("Customer") agree to comply with this AUP, our Terms of Service, and all applicable laws and regulations.

1. Scope

This AUP applies to all Customers, end users, and any third parties who access or use the Services. Customers are responsible for ensuring that any use of the Services by third parties complies with this AUP.

2. Prohibited Activities

The following activities are strictly prohibited:

• Illegal or Fraudulent Activities — Using the Services in any manner that violates applicable laws or regulations, including the storage, distribution, or transmission of illegal content.
• Security & Network Abuse — Attempting to breach or circumvent security measures, engaging in network scanning, denial‑of‑service (DoS/DDoS) attacks, or any activity that disrupts or degrades the reliability or performance of the Services or any third‑party network.
• Unsolicited Communications — Sending spam, bulk email, or other unsolicited messages in violation of the CAN‑SPAM Act or similar laws.
• Malware & Harmful Code — Hosting, distributing, or transmitting viruses, worms, trojan horses, ransomware, or any code intended to damage or compromise data or systems.
• Intellectual Property Infringement — Storing or distributing content that breaches copyrights, trademarks, patents, or other proprietary rights.
• Resource Abuse — Excessively consuming CPU, bandwidth, or other resources in a manner that impacts service stability for others (e.g., unrestricted cryptocurrency mining without prior approval).

3. Content Restrictions

Customers may not host, store, or transmit content that:

• Depicts or exploits minors (Child Sexual Abuse Material).
• Promotes violence, terrorism, or extremist ideology.
• Facilitates human trafficking or the sale of illicit goods.
• Encourages hate or discrimination against protected groups.
• Is defamatory, obscene, or otherwise unlawful.

4. Security & Compliance Obligations

• Customers must maintain security patches, configurations, and access controls on their own servers or virtual machines.
• Any compromise of Customer environments (e.g., malware infection) must be resolved promptly to prevent harm to other network users.
• Customers must comply with data‑protection laws applicable to the jurisdictions in which they operate.

5. Enforcement & Penalties

Violations of this AUP may result in immediate actions, including but not limited to:

• Temporary or permanent suspension of Services.
• Removal of infringing content.
• Imposition of service restoration fees or additional security deposits.
• Termination of the Customer account.
• Referral to law‑enforcement authorities where required.

6. Reporting Violations

7. Changes to This Policy

We may modify this AUP from time to time. Updated versions will be posted on our website with a revised "Effective Date". Continued use of the Services after the Effective Date constitutes acceptance of the updated terms.
