Carmen Hosting Company ("Carmen," "we," "us," or "our") respects the intellectual property rights of others and expects its customers and users to do the same. In accordance with the Digital Millennium Copyright Act, 17 U.S.C. §512 ("DMCA"), this policy outlines our procedures for handling claims of copyright infringement relating to any content hosted on or transmitted through our virtual private servers (VPS), dedicated servers, and colocation cabinets (collectively, the "Services").

2. Notice of Claimed Infringement

If you believe that material residing on or accessible through our Services infringes your copyright, you must send a written notice that includes:

  1. Your physical or electronic signature (or that of a person authorized to act on your behalf).
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list of works if multiple are covered by a single notification.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., URLs, server IP, file paths).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good‑faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.

Notices that do not meet the DMCA requirements may be invalid. Upon receipt of a valid notice, we will promptly remove or disable access to the allegedly infringing material and notify the affected customer.

3. Counter‑Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may submit a counter‑notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before removal or disablement.
  3. A statement under penalty of perjury that you have a good‑faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, for any judicial district in which Carmen may be found, and that you will accept service of process from the person who provided the original DMCA notice or their agent.

Upon receipt of a valid counter‑notification, we will forward it to the original claimant. If the claimant does not file an action seeking a court order within ten (10) business days, we may restore the material.

4. Repeat Infringers

In accordance with the DMCA, Carmen has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, account holders who are deemed to be repeat infringers.

5. Misrepresentation

Any person who knowingly materially misrepresents that material or activity is infringing, or that it was removed or disabled by mistake, may be subject to liability under 17 U.S.C. §512(f).

6. Modifications

We may revise this DMCA Policy at any time. Updated versions will be posted on our website with an updated "Effective Date." Continued use of the Services following such changes constitutes acceptance of the revised policy.
